PROFESSIONAL LIABILITY ADVISORY, ON-TOUR ADVISOR SCOPE, AND TRAVEL INSURANCE ELECTION FORM

IMPORTANT NOTICE TO TRAVELER: The Diamond Journeys LLC (“TDJ”) provides bespoke travel planning, curation, concierge, and on-tour professional advisory services. This document contains critical professional disclosures, limitations of liability regarding on-tour hosting, authority for group management, and a mandatory travel insurance election. Execution of this document, or the submission of any financial payment to TDJ, constitutes absolute acceptance of these terms.

SECTION 1: SCOPE OF PROFESSIONAL SERVICES & ON-TOUR ADVISORY ROLE

Traveler acknowledges that TDJ operates in a dual capacity: as a professional planning facilitator/intermediary concierge prior to departure, and as an on-tour Travel Advisor, host, and coordinator during the trip.

As an on-tour Travel Advisor, TDJ’s role is strictly limited to the logistical management of the group itinerary, acting as a liaison with local independent suppliers, and providing general cultural, historical, or travel-related advisories. TDJ does not operate in any capacity as a medical professional, certified athletic trainer, structural safety inspector, security detail, or legal counsel. Professional recommendations made on-tour by TDJ are advisory in nature, and Traveler retains final personal autonomy and liability for their own safety, health boundaries, and choices.

SECTION 2: LIMITATION OF LIABILITY FOR ADVISORY & ON-TOUR DECISIONS (E&O PROTECTION)

To the maximum extent permitted by the laws of the State of Delaware, Traveler agrees to limit the professional liability of TDJ, its members, managers, and employees for any professional errors, omissions, administrative mistakes, or on-tour advisory oversights.

• Maximum Financial Cap: TDJ’s total aggregate liability for any demonstrated professional negligence, booking error, or on-tour advisory mistake shall be strictly capped at, and shall not exceed, the total professional planning, concierge, or hosting fees paid directly to TDJ by the Traveler for the specific itinerary in question.

• Dynamic On-Tour Adjustments: Traveler acknowledges that group travel requires dynamic management. TDJ reserves the professional right to modify routes, change scheduled activities, substitute restaurants, or adjust timelines on the ground due to weather, local closures, strikes, supplier availability, safety concerns, or group pacing. Such spontaneous professional adjustments made by the on-tour Advisor are designed for the collective benefit of the tour and shall not constitute an error, omission, or grounds for financial claims or refunds.

• Exclusion of Consequential Damages: Under no circumstances shall TDJ be liable for incidental, consequential, special, indirect, or punitive damages (including alternative travel costs, emotional distress, or missed opportunities) arising out of any planning or on-tour coordination.

SECTION 3: ON-TOUR CONDUCT, GROUP SAFETY, AND AUTHORITY FOR REMOVAL

Because the Travel Advisor accompanies the group on the ground, Traveler is expected to behave respectfully toward fellow travelers, guides, drivers, hotel staff, and local communities.

To protect the safety, professional execution, and collective experience of the tour, TDJ retains the absolute professional authority to immediately terminate services and remove any participant from a tour at any time, without refund, for:

• Intoxication or substance abuse

• Illegal activity under local destination laws

• Verbal harassment, abusive conduct, or physical threats

• Disobedient or disruptive behavior that compromises group safety or materially impairs the itinerary.

Upon notification of removal by the on-tour Advisor, TDJ’s professional and custodial responsibility to the Traveler ceases instantly. Any and all resulting costs, alternative accommodations, or immediate repatriation flights shall be the sole financial responsibility of the removed traveler.

SECTION 4: INDEPENDENT SUPPLIER DISCLOSURE & ON-TOUR EXECUTION

TDJ makes every reasonable professional effort to vet and recommend premium independent contractors (including hotels, transportation companies, guides, restaurants, and activity providers). However, these suppliers are completely independent entities and are not employees or agents of TDJ.

TDJ does not control their personnel, maintenance, or safety protocols. TDJ shall be held completely harmless for financial losses, scheduling disruptions, structural failures, or personal injury caused by supplier bankruptcies, operational defaults, negligence, or sudden cessations of service. If a supplier fails to perform while a tour is in progress, TDJ's on-tour role is strictly limited to offering reasonable administrative assistance to help identify alternative arrangements at the Traveler's sole additional expense.

SECTION 5: PASSPORTS, VISAS, AND LOCAL COMPLIANCE RESPONSIBILITY

While the on-tour Travel Advisor may provide logistical guidance regarding customs, immigration, or health protocols, the Traveler acknowledges that it remains their sole, non-delegable legal responsibility to maintain valid travel documentation (including a passport valid for at least six months beyond travel dates) and comply with all local laws of the destination countries. TDJ shall not be liable for any professional error, financial loss, or trip interruption resulting from a traveler being detained, delayed, or denied transit/entry by local authorities.

SECTION 6: MANDATORY TRAVEL INSURANCE ADVISORY & ELECTION

Travel insurance policies offer essential protection against unforeseen financial losses, trip interruptions, medical emergencies abroad, and emergency medical evacuations. TDJ strongly advises the purchase of a comprehensive policy, including "Cancel For Any Reason" (CFAR) coverage if available.

I have chosen to decline travel insurance coverage for this itinerary against the express recommendation of TDJ. By selecting this option, I voluntarily assume all financial risks associated with trip cancellation, interruption, lost luggage, medical expenses abroad, or emergency medical evacuation. I explicitly waive any right to hold TDJ professionally or financially liable for out-of-pocket costs, non-refundable supplier penalties, or losses that a standard travel insurance policy would have otherwise covered.

SECTION 7: CLIENT VALIDATION OF BOOKING ACCURACY

Traveler agrees to thoroughly review all booking confirmations, receipts, invoices, flight itineraries, and passenger name spellings provided by TDJ within twenty-four (24) hours of receipt. Traveler must immediately notify TDJ in writing of any discrepancies. Failure to notify TDJ within this 24-hour window constitutes absolute confirmation that the data is accepted as completely accurate, shifting subsequent change fees or rebooking costs entirely to the Traveler.

SECTION 8: IMPLIED ACCEPTANCE VIA PAYMENT & CONFLICT RESOLUTION

• Implied Acceptance: Submission of an initial deposit, booking invoice payment, or partial payment for any tour package arranged by TDJ constitutes complete, irrevocable acceptance of all terms, liability caps, and disclosures contained within this Advisory on behalf of all travelers included in the reservation, regardless of whether a physical signature has been returned.

• Governing Law: This Advisory and all professional services rendered by TDJ shall be governed exclusively by the laws of the State of Delaware.
