MASTER TRAVEL AGREEMENT & TERMS AND CONDITIONS OF TRAVEL

PLEASE READ CAREFULLY.

These Terms and Conditions constitute a legally binding agreement between The Diamond Journeys LLC (“TDJ”) and the traveler (“Traveler”). By submitting a reservation, deposit, payment, signed registration form, electronic acceptance, or by participating in any travel experience arranged by TDJ, Traveler acknowledges that Traveler has read, understands, and agrees to be bound by these Terms and Conditions.

ARTICLE 1: AGENCY RELATIONSHIP

1.1 Limited Role of TDJ: The Diamond Journeys LLC acts solely as an intermediary between Traveler and independent travel suppliers (including hotels, airlines, golf operators, cruise lines, transportation providers, restaurants, guides, and activity providers). TDJ does not own, operate, manage, supervise, or control any travel supplier.

1.2 No Joint Venture: Nothing contained herein shall be construed as creating a partnership, joint venture, agency, employment, or fiduciary relationship between TDJ and any supplier.

ARTICLE 2: INDEPENDENT CONTRACTORS

All suppliers providing services are independent contractors. TDJ shall not be responsible for negligence, gross negligence, errors, omissions, delays, bankruptcy, insolvency, operational failures, overbookings, strikes, labor disputes, misconduct, or criminal acts of any supplier. Traveler expressly acknowledges that suppliers maintain exclusive control over their own operations.

ARTICLE 3: LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Diamond Journeys LLC shall not be liable for any injury, illness, death, emotional distress, inconvenience, loss, theft, property damage, delay, cancellation, interruption, expense, or financial loss arising from travel participation, supplier actions/omissions, force majeure, or criminal conduct of third parties. The maximum aggregate liability of TDJ shall not exceed the amount paid directly to TDJ by Traveler for the applicable travel program. TDJ shall not be liable for consequential, incidental, special, punitive, or indirect damages.

ARTICLE 4: RELEASE OF SUPPLIER LIABILITY

Traveler expressly releases TDJ from any claim arising from airlines, hotels, golf courses, transportation providers, tour guides, activity providers, cruise lines, restaurants, and local vendors, including claims arising from negligence, injury, illness, property loss, delays, cancellations, or service failures.

ARTICLE 5: ASSUMPTION OF TRAVEL RISKS

Traveler acknowledges that international and domestic travel involve inherent risks (including illness, injury, death, transportation accidents, food-related illness, crime, theft, political instability, terrorism, civil unrest, weather, natural disasters, and public health emergencies). Traveler knowingly and voluntarily assumes all such risks.

ARTICLE 6: FORCE MAJEURE

TDJ shall not be responsible for failure to perform due to events beyond its control (e.g., Acts of God, pandemics, government restrictions, border closures, travel advisories, war, strikes, or supplier insolvency). No refunds shall be due except to the extent received from suppliers.

ARTICLE 7: ITINERARY MODIFICATIONS

TDJ reserves the right to substitute hotels, modify transportation, change activities, replace guides, alter schedules, or change venues when necessary. Such modifications shall not constitute grounds for cancellation or refund.

ARTICLE 8: TRAVELER RESPONSIBILITIES

Traveler is solely responsible for valid passports, visas, entry documentation, vaccinations, medical clearances, travel insurance, personal medications, and compliance with local laws. Failure to satisfy these requirements shall not entitle Traveler to refunds.

ARTICLE 9: MEDICAL FITNESS

Traveler warrants they are physically capable of participating and agrees to disclose mobility limitations. TDJ reserves the right to refuse participation when Traveler’s condition may create risk to Traveler or others.

ARTICLE 10: TRAVEL INSURANCE

TDJ strongly recommends and may require travel insurance (covering trip cancellation, interruption, medical, evacuation, delay, and baggage). Failure to obtain insurance is at Traveler’s own risk.

ARTICLE 11: PERSONAL PROPERTY

TDJ is not responsible for loss, theft, or damage to personal belongings (luggage, electronics, passports, cash, etc.).

ARTICLE 12: ALCOHOL CONSUMPTION

Traveler assumes full responsibility for all decisions and actions involving alcohol consumption during tours, tastings, or dinners.

ARTICLE 13: ACTIVITY PARTICIPATION

Participation in activities is voluntary. Traveler may decline any activity; however, no refunds shall be issued for missed activities.

ARTICLE 14: GOLF ACTIVITIES

Golf participation involves inherent risks (struck balls, falls, weather, equipment issues) and is undertaken entirely at Traveler’s own risk.

ARTICLE 15: PHOTOGRAPHY RELEASE

Unless Traveler opts out in writing prior to departure, Traveler grants TDJ permission to use photographs, video, testimonials, and likenesses for marketing and promotional materials without compensation.

ARTICLE 16: CLAIMS DEADLINE

Any claim against TDJ must be submitted in writing within thirty (30) days after completion of travel. Failure to provide timely notice constitutes a waiver of such claim.

ARTICLE 17: LIMITATION PERIOD

Any legal action against TDJ must be commenced within one (1) year of the event giving rise to the claim.

ARTICLE 18: ARBITRATION

Any dispute arising from these Terms and Conditions shall be resolved exclusively through binding arbitration administered by the American Arbitration Association. Traveler waives the right to a jury trial.

ARTICLE 19: CLASS ACTION WAIVER

Traveler agrees that all claims shall be brought solely in an individual capacity, waiving participation in class, collective, representative, or mass arbitration proceedings.

ARTICLE 20: GOVERNING LAW

These Terms and Conditions shall be governed exclusively by the laws of the State of Delaware.

ARTICLE 21: SEVERABILITY

If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.

ARTICLE 22: ENTIRE AGREEMENT

These Terms and Conditions, together with all other provided waivers and documents, constitute the entire agreement between Traveler and TDJ.

TRAVELER ACKNOWLEDGMENT

I have carefully read and understand these Terms and Conditions. I understand that I am waiving certain legal rights and voluntarily agree to all provisions.
